Protect Your Assets From a Medicaid Spend Down

No one ever wants to end up in a nursing home!  But the fact is that at least some point in life, we all will need the care of others to help with daily living activities (cooking, cleaning, dressing, bathing, etc.).  Requiring any level of care requires the assistance from friends and family but more likely requires the assistance from a paid professional.   If you need that care, the money can only come from one of a few places: (1) out-of-pocket; (2) Medicaid assistance; (3) Long-term care insurance; or (4) Veterans Assistance.   Medicaid will pay for you to enter a nursing home but it comes with a great expense.  In order to be eligible for Medicaid you must spend down all your assets first.   Thus, your home, bank accounts, retirement accounts, and what you’ve spent a lifetime trying to build, must all be extinguished and spent down before you can receive Medicaid federal financial assistance.   In the unfortunate event that you need to go into a nursing home or some form of assisted living, a Medicaid planning attorney at Baron Law LLC can set up strategies to protect your assets.  Contact us today and learn more on how a Family Asset Protection Trust can protect you and your family.

Plan Ahead – Family Asset Protection Trust

With the average cost of a nursing home exceeding $10,000.00 per-month, Medicaid planning and elder law have become vastly in demand. Protecting your assets against a Medicaid spend down comes with a complex web of federal law.  Baron Law LLC will help you navigate through this complex web by providing a variety of options.   Through careful planning, you may be able to save your home, retirement, and savings through an irrevocable trust or alternative asset protection trust.  One such trust that we consider is called a Medicaid Asset Protection Trust, or “MAPT.”  In most cases the MAPT names someone other than you or your spouse as the trustee, usually one or more adult children, and provides income to the creator of the trust.   The MAPT trusts are ideal for the family home or assets you are only taking income from or is simply reinvesting.  Most importantly, your lifestyle is not generally affected since you continue to receive a pension and/or Social Security.  Additionally, we ensure that the trust affords each client the exclusive right to use and occupy the home and preserve all the tax exemptions on the home where possible.  Through an initial free consultation, we will discuss your long-term care concerns and determine if a MAPT is right for you.  To learn more or to set up a free one-hour consultation, please contact our office.

Mary Bryk

Daniel Baron reviewed our Trust, Wills and HPOA. He provided good feedback as to what needed updating and any necessary additions to the documents. We didn’t have a FPOA which thanks to him we now have. He was able answer any questions we had and proved to be very flexible to accommodate our schedules when it came time to meet. I would recommend him to anyone looking to do Estate Planning.

Dan helped us wade through the confusion of estate planning. He was so easy to work with and answered all of our questions in terms we could understand.

Dan was very knowledgeable, efficient, organized and responsive. We will be using him for future needs and would recommend him to others

Wills, financial power of attorney, living will, health care power of attorney – all the things you love to put off. If I had known it could be this easy I would have done years ago. Informative, very easy to talk to, Dan was great.

I am the one who is privileged to be represented by Mr. Baron. I am very satisfied with the outcome of my case. Mr. Baron did a great job handling everything. His ability to sort out the details and highlight the important evidence stood out in court. My calls and emails were returned in a timely manner. I would refer my family and friends to him only. Thank you again for the remarkable job.

“We trust Dan Baron as our attorney because he has hands-on experience in our industry.”
